Some have asked why Health Care is being decided on the last day. For one thing, it was only argued in late March and it often takes several months to write opinions in complicated cases. In addition, in big cases where there are multiple opinions, it takes a while for the dissents and concurrences to get written. Finally, the Justices often just take as much time as is available to polish their opinions in big cases.

The Court will start at 10am, but we don't expect to get the Healthcare decision until around 10:15. That is because it is likely that the Court will announce its decision in two other pending cases before it gets to Health Care.

When the Justices take the bench, the Marshal -- Pamela Talkin -- will pound the gavel and with an "Oyez, oyez," announce that the Court is in session. The n the Chief Justice will take over. He will say something along the lines of "Justice Thomas (this is all just speculation) has the opinion for the Court in No. [whatever], First American Financial Corp v. Edwards," Then the Justice with the first opinion will read a summary of the decision; if a Justice dissents and decides to read a summary, he/she may do so. Then the Chief Justice will announce who has the second opinion, etc. , in the same way.

Justice Ginsburg makes clear that the vote is 5-4 on sustaining the mandate as a form of tax. Her opinion, for herself and Sotomayor, Breyer and Kagan, joins the key section of Roberts opinion on that point. She would go further and uphold the mandate under the Commerce Clause, which Roberts wouldn't. Her opinion on Commerce does not control.
