Gov't Temporarily Bans IBM From Deals

Gov't Temporarily Suspends IBM From Doing Business With Agencies While EPA Probes Matter

WASHINGTON (AP) -- IBM Corp. has been temporarily banned from receiving future contracts with federal agencies, the Environmental Protection Agency confirmed on Monday.

The suspension went into effect last Thursday "while the agency reviews concerns raised about potential activities involving an EPA procurement," the agency said Monday in an e-mailed statement. Under a reciprocal agreement among federal agencies, when one issues a ban, the others follow it.

EPA said it will not comment further on the matter.

Armonk, N.Y.-based IBM currently has prime federal contracts worth at least $1.3 billion, or about 1 percent of its 2007 revenue, which largely will not be affected by the suspension, an analyst said.

IBM spokesman Fred McNeese said he had no immediate comment.

The suspension could be serious, but the reason for the ban is unclear at the moment, said Ray Bjorklund, a senior vice president at market research firm Federal Sources Inc.

"It's potentially a big deal," he said.

Bjorklund said that, until the matter is resolved, all federal agencies are likely not to award new contracts or even task orders -- pieces of existing contracts -- to IBM. The ban could last a few days or a few months, he said. However, Bjorklund said agencies do have some leeway to award a contract if there is a specialized requirement that only the suspended company could perform.

Stan Soloway, who heads the Professional Services Council, a trade group representing IBM and other government contractors, complained that the EPA had imposed the suspension without first informing IBM of its concerns and letting the company respond.

"A suspension is normally not assessed unless there is a very serious infraction that has been not only alleged but documented," he said. He called the EPA move "very unusual" and said "it has enormous ramifications."

Shares of IBM fell 64 cents to $114.50 in after-hours trading after it rose 57 cents to close at $115.14 in the regular session.

IBM Learns of Temporary Suspension from New Business with U.S. Federal Government
Monday March 31, 5:38 pm ET

 

ARMONK, N.Y.--(BUSINESS WIRE)--IBM (NYSE: IBM) announced today that it has learned that it has been temporarily suspended from participating in new business with U.S. Federal government agencies.
 
The notice of temporary suspension was issued by the Environmental Protection Agency (EPA) and relates to an investigation by the EPA of possible violations of the Procurement Integrity provisions of the Office of Federal Procurement Policy Act regarding a bid for business with the EPA originally submitted in March 2006. The temporary suspension applies to all Federal agencies and IBM business units. IBM may continue awards in existence as of the date of this suspension, unless a particular agency directs otherwise.

In addition, the U.S. Attorneys Office for the Eastern District of Virginia has served IBM and certain employees with grand jury subpoenas requesting testimony and documents regarding interactions between employees of the EPA and certain IBM employees.

IBM has served the Federal agency community for many decades as a vendor in good standing and is committed to the highest standards of business ethics. IBM provides training on its Business Conduct Guidelines to all employees, with specialized training to those employees working on matters with the Federal government, to ensure compliance with all applicable Federal requirements.

Prior to learning of the temporary suspension on March 28, 2008, IBM was not aware that the EPA or U.S. Attorneys office were considering any action against IBM. Upon learning of the suspension, IBM initiated discussions with the EPA and the U.S. Attorneys office to obtain additional information and is cooperating with the investigations.

Under Federal procurement procedures, IBM has 30 days in which to contest the scope of the temporary suspension, which can continue for an initial period of up to one year pending the completion of the investigation. IBM intends to take all appropriate actions to challenge the suspension and limit its scope.

等到今天政府才发布这个消息。。。明天是四月1日。。。愚人节。。。。。。

这样也算是给大家一个缓冲的机会吧,或者这条消息并不那么引人注意呢。至少,美国政府的合同不给IBM, 也会给其它公司。所以应该对经济和整个股票市场没什么影响,顶多也就是影响IBM一家的股票而已。

前几天可是靠拉IBM,来拉抬DOW.

看来MM现在准备打压DOW了。

US Attorneys Probe IBM-EPA Interaction; Company Banned From Doing New Deals With Agencies

WASHINGTON (AP) -- IBM Corp. and certain employees received subpoenas from a federal grand jury seeking testimony and documents relating to a contract it sought with the Environmental Protection Agency, the company said on Monday.
 
The company also has been temporarily banned from receiving future contracts with all federal agencies.

The suspension went into effect last Thursday "while the agency reviews concerns raised about potential activities involving an EPA procurement," the agency said Monday in an e-mailed statement. Under a reciprocal agreement among federal agencies, when one issues a ban, the others follow it.

EPA said it will not comment further on the matter.

IBM said the U.S. Attorney's Office for the Eastern District of Virginia served the grand jury subpoenas, but it did not say when.

The Armonk, N.Y.-based company currently has prime federal contracts worth at least $1.3 billion, or about 1 percent of its 2007 revenue, which largely will not be affected by the suspension, an analyst said.

IBM spokesman Fred McNeese said the company is still talking with the EPA about the alleged violation and would not describe the contract that IBM was bidding on that led to the suspension.

The company learned about the ban on Friday, but "prior to that (we had) no indication there was a dispute between the IBM and EPA. We've spent most of the day trying to determine what's going on," McNeese added.

The company said it has 30 days to contest the scope of the suspension, which can continue for up to one year pending the completion of EPA's investigation.

SAN FRANCISCO (MarketWatch) -- IBM Corp. has been temporarily banned from new business with the federal government and is being investigated by the U.S. Attorney's office for the Eastern District of Virginia over a contract awarded by the Environmental Protection Agency, the company said Monday.
The EPA is also conducting its own investigation, IBM said. The suspension and investigations are related to possible violations of procurement rules as part of a "bid for business with the EPA originally submitted in March 2006," IBM said in a statement.
The reasons for the ban and investigations weren't immediately clear.
While the contract in question relates solely to the EPA, the contracting ban applies to all federal agencies, IBM said.
IBM 115.14, +0.57, +0.5%) said it first learned of the suspension and investigations on Friday, adding that it's being allowed to continue work on government contracts already in progress.
An EPA spokesman did not immediately respond to a request for comment. A representative of the U.S. Attorney's office for the Eastern District of Virginia did not respond to a request for comment.
IBM said the U.S. Attorney's office served "IBM and certain employees with grand jury subpoenas requesting testimony and documents" related to interaction between EPA and IBM employees.
